1. Acceptance of Terms
By submitting the registration form, making payment, or requesting activation, the applicant confirms that these Terms and Conditions, including the User Terms of NRI Care Kerala, have been read, understood, and accepted, and that membership shall be governed by them from activation onward.
2. Electronic Consent
The member agrees that form submission, checkbox acceptance, digital communication, online confirmation, and electronic payment records together constitute valid evidence of consent, instructions, and acceptance, and may be relied upon by NRI Care Kerala in accordance with the User Terms of NRI Care Kerala.
3. Eligibility to Join
Membership is available only to persons legally competent to contract. By registering, the applicant confirms legal capacity, genuine intent, and lawful authority to request support for themselves, their family, property, documents, or related matters lawfully under the User Terms of NRI Care Kerala.
4. Accurate Identity
The applicant confirms that all personal details, addresses, contact numbers, identification particulars, and supporting information provided during registration are true, current, and complete, and shall immediately correct any error, omission, or material change affecting membership.
5. Membership Nature
Membership creates a structured service relationship for coordination and support under the User Terms of NRI Care Kerala. It does not create employment, agency, partnership, fiduciary duty, legal representation, or guaranteed obligations beyond the services expressly accepted in writing by NRI Care Kerala services.
6. Scope of Membership
Membership provides access to organised support, communication, and coordination within the services offered by NRI Care Kerala under the User Terms of NRI Care Kerala. It does not guarantee that every request can be accepted, completed, approved, or resolved in the manner expected.
7. No Guaranteed Outcomes
NRI Care Kerala offers support, coordination, follow-up, and reasonable assistance under the User Terms of NRI Care Kerala, but does not guarantee approvals, appointments, official decisions, institutional responses, document issuance, legal results, medical outcomes, or third-party performance under any circumstances.
8. Government Rule Changes
The member accepts that government rules, office procedures, statutory requirements, institutional practices, and local regulations may change without notice. NRI Care Kerala shall not be liable under the User Terms of NRI Care Kerala where such changes delay, restrict, alter, or prevent support.
9. Mandatory Personal Presence
Certain matters may require the personal presence of the member, family member, owner, signatory, patient, applicant, or concerned person before an authority, office, hospital, institution, bank, or court. Support under the User Terms of NRI Care Kerala cannot bypass attendance requirements under law.
10. Membership Activation
Membership becomes active only after the registration form is properly submitted, payment is successfully received, and NRI Care Kerala confirms activation or onboarding under the User Terms of NRI Care Kerala. No entitlement, service expectation, or active membership relationship arises before such confirmation.
11. Membership Duration
Membership remains valid only for the duration of the selected plan, beginning on the activation date confirmed by NRI Care Kerala under the NRI Care Kerala User Terms. Services, support access, and member privileges automatically end when the applicable membership period expires.
12. Renewal and Expiry
Membership does not continue indefinitely unless renewed. Renewal remains subject to then-current plans, pricing, availability, and terms, including the NRI Care Kerala User Terms. Unused time, unrequested support, or incomplete expectations do not extend, pause, or carry forward membership after expiry automatically.
13. Fees and Separate Costs
All membership fees are payable in advance under the NRI Care Kerala User Terms and are separate from government fees, statutory charges, professional fees, courier expenses, travel costs, document charges, medical costs, taxes, or third-party payments, unless expressly included in writing separately.
14. Accuracy of Information
The member is responsible for the accuracy, legality, completeness, and authenticity of all information, documents, and instructions provided under the NRI Care Kerala User Terms. NRI Care Kerala shall not be liable for consequences arising from inaccurate, forged, incomplete, or misleading material.
15. Member Cooperation
The member agrees to provide timely responses, documents, signatures, authorisations, clarifications, and confirmations required for support. Delay, refusal, silence, or non-cooperation may prevent performance, pause handling, or lead to closure of the relevant request entirely.
16. Estimated Timelines
Any timeline, estimate, expectation, or anticipated completion date shared by NRI Care Kerala is indicative only. Actual progress may vary depending on documentation, cooperation, government practice, third-party response, holidays, emergencies, and circumstances beyond operational control.
17. Third-Party Providers
Where lawyers, hospitals, consultants, brokers, drivers, couriers, agents, institutions, or other providers are involved, NRI Care Kerala acts only in a coordinating capacity and is not responsible for fees, conduct, negligence, delay, refusal, or outcomes.
18. No Professional Advice
Unless expressly agreed in writing, membership support does not constitute legal, medical, financial, tax, immigration, investment, or psychiatric advice. Members remain responsible for obtaining independent professional advice wherever specialised or regulated advice is necessary independently.
19. Cancellation Window
A member may request cancellation within fourteen days from payment or activation, whichever occurs earlier, only if no consultation, coordination, review, communication handling, request processing, document action, appointment arrangement, or support activity has been initiated.
20. No Refund Policy
Membership fees are non-refundable. The fee covers onboarding, access, time, planning, communication, administrative effort, coordination readiness, and support structure. No refund shall arise merely because expectations change, future needs reduce, or desired outcomes remain unavailable.
21. Use of Service Ends Cancellation
If the member seeks consultation, shares documents for action, requests coordination, communicates a matter for handling, or otherwise uses membership support during the cancellation period, the right to cancel or claim refund immediately ceases thereafter.
22. No Refund for External Outcomes
No refund shall be payable because an authority refuses action, an institution delays response, a third party fails, a rule changes, or an expected result is not achieved, where support efforts were provided in faith.
23. Dormant Request Closure
If the member fails to respond, provide documents, or cooperate within a reasonable time, NRI Care Kerala may treat the matter as inactive, pause handling, or close the request without liability, extension, or refund whatsoever.
24. Member Conduct
Members shall communicate respectfully, lawfully, and honestly. Abusive language, threats, intimidation, defamatory statements, unlawful demands, harassment, or misuse of services may result in refusal, suspension, termination, legal response, or restriction of further communication and support.
25. Right to Refuse, Suspend, or Terminate
NRI Care Kerala may refuse, suspend, or terminate membership or any request where there is non-cooperation, document concern, misrepresentation, unlawful purpose, operational impracticality, payment issue, reputational risk, conflict of interest, or unacceptable member conduct whatsoever.
26. Privacy, Confidentiality, and Lawful Sharing
NRI Care Kerala will handle member information with reasonable care and confidentiality, and may collect, store, use, process, and share information with staff, consultants, service partners, or authorities where reasonably required for support or compliance.
27. Electronic Communications and Records
The member consents to communication through phone, email, messaging platforms, digital forms, video calls, and electronic documents. Electronic records, screenshots, payment confirmations, and communication logs maintained by NRI Care Kerala may serve as reliable evidence.
28. Non-Transferability
Membership is personal to the registered member and cannot be assigned, transferred, resold, shared, sublicensed, or used by another person without prior approval from NRI Care Kerala, which may be granted or refused at discretion.
29. Authority to Act
If a member registers for or requests support concerning another person, the member confirms having that person’s consent or authority. NRI Care Kerala may request proof of authority before accepting, continuing, or completing the matter.
30. Indemnity
The member agrees to indemnify and hold harmless NRI Care Kerala, its founders, staff, and representatives against claims, losses, expenses, liabilities, penalties, or proceedings arising from false information, unlawful instructions, forged documents, or member-related disputes.
31. Limitation of Liability
To the maximum extent permitted by law, NRI Care Kerala’s aggregate liability shall not exceed the membership fee actually paid. Indirect, consequential, reputational, emotional, travel, business, opportunity, or third-party losses are expressly excluded from recovery.
32. Force Majeure
NRI Care Kerala shall not be liable for delay, interruption, or non-performance caused by natural disaster, epidemic, transport disruption, illness, strike, office closure, internet failure, war, civil unrest, government restriction, or any event beyond control.
33. Contact Information Updates
The member shall update contact details, addresses, and communication preferences whenever they change. NRI Care Kerala shall not be responsible for missed notices, delays, or misunderstandings resulting from outdated contact information supplied by the member.
34. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by applicable Indian law. Subject to mandatory law, disputes arising from membership, support, payments, or related matters shall be subject to the competent courts of Thiruvananthapuram, Kerala alone.
35. Severability, Waiver, and Amendments
If any provision becomes unenforceable, the remaining provisions shall continue. Delay in enforcement shall not amount to waiver. NRI Care Kerala may amend these terms, and updated terms shall apply from publication or communication thereafter.
